Sen. Warren Hamilton Files Legislation to Protect Oklahomans from Green Energy Overreach

OKLAHOMA CITY – Sen. Warren Hamilton, R-McCurtain, recently filed two pieces of legislation to protect Oklahoma property owners and residents from overreaching efforts to construct green energy facilities across the state. Hamilton’s Senate Bill 994 would prohibit the use of eminent domain for the purpose of building wind energy, solar energy, battery storage, or other green energy facilities on private property.

“In southeastern Oklahoma, and in countless other communities across our state, residents have continued to fight to prevent green energy facilities from encroaching on their properties and homes,” Hamilton said. “This legislation would ensure that no Oklahoman is forced to give up their home for the establishment or operation of such facilities that disrupt communities and harm residents’ way of life.”

Hamilton also filed Senate Bill 429, which would require wind turbines to be located at least 1.5 miles away from the nearest point of any residential dwelling or nonparticipating property.

“While many Oklahomans have concerns related to the construction of green energy facilities near their homes, wind energy facilities are particularly concerning due to their noise levels, effect on the local environment and landscape, and the potential impact on the value of the homes and properties they have worked incredibly hard for,” Hamilton said. “We will stand firm with Oklahoma citizens to defend our state’s values and safeguard the rights of property owners.”

SB429 and SB994 are eligible for consideration in the 2025 legislative session, which begins Feb. 3.
