Oklahoma Standby Guardianship Act becomes law

OKLAHOMA CITY – Legislation creating the “Oklahoma Standby Guardianship Act” has been signed into law. Senate Bill 1701, by Sen. Michael Brooks, D-Oklahoma City, and Rep. Chris Kannady, R-Oklahoma City, creates a legal framework so that parents can designate a “standby” guardian under certain circumstances.

“This new law will empower parents to proactively name a guardian under extenuating circumstances,” Brooks said.  “The bill enables them to choose the person they want to care for their child should they be deployed by the military, face court proceedings, a health crisis, or other such events. I appreciate Representative Kannady’s work on this bill, the support of my fellow members in the Legislature, and thank Governor Stitt for signing this measure into law.”

"Senate Bill 1701 outlines clear legal guidelines for Oklahoma parents to approve or revoke standby guardians, offering reassurance in unexpected situations,” Kannady said. “I appreciate Sen. Brooks' work on this measure that prioritizes the well-being of children and families."

SB 1701 will become effective Nov. 1, 2024.
