In October 2011, Sen. Kim David requested an Attorney General’s opinion on the legality of Wagoner County’s planning and zoning ordinances following concerns raised by local residents. On Tuesday, the Attorney General’s office sent their opinion upholding the current practice of planning and zoning by the county commissioners. A copy of the opinion will be sent to each Wagoner county commissioner.
“I want to thank the Attorney General’s office for their expedited opinion on this very important issue to the residents of Wagoner County. I also want to thank Commissioner James Hanning for bringing this issue to my attention and asking that I request an opinion from the A.G.’s office. Due to his diligence we now have affirmation of the legality of Wagoner County’s planning and zoning regulations, which should clear up any questions or doubts local residents had about this issue.”
David and other county officials did find that current state statutes regarding county wide planning and zoning are confusing and have conflicting language. As this affects all counties in Oklahoma, David will be working to address these concerns in the Legislature.
